GENERAL CONDITIONS OF SALE ONLINE AND BY TELEPHONE

Preliminary article

 

These General Terms and Conditions of Sale are those of Le Tapis Rouge Paris, a limited liability company with a share capital of 5,000 euros, having its registered office at 58 rue du Faubourg Poissonnière, 75010 Paris, registered in the Paris Trade and Companies Register under number 911 344 497 - E-mail address: contact@letapisrougeparis.com ; VAT FR 39 911344497 (hereinafter " Le Tapis Rouge Paris ").

Le Tapis Rouge Paris creates, designs, manufactures and markets pet supplies worldwide.

Article 1 - Scope and acceptance of the General Terms and Conditions of Sale

The present General Conditions of Sale are applicable to all the sales of Articles concluded at distance:

Via the website of Le Tapis Rouge Paris identified by the domain name "http://www.letapisrougeparis.com/fr_fr" (hereinafter the " Site ").

The Articles are sold to end customers who are natural persons, acting for strictly personal purposes and not for any commercial activity, thus excluding any resellers or any intermediaries acting in the name and on behalf of resellers (hereinafter the " Customer (s)" or " you ").

Therefore, Customer represents and warrants that it is acting as a consumer and does not intend to resell the Items for commercial purposes.

The Customer also certifies that he/she has the legal capacity to commit himself/herself under the terms of the present General Sales Conditions.

At the time of each purchase of Article(s) on the Site, the Customer will have to indicate his acceptance of the General Conditions of Sale in force by clicking on the button "Pay and place an order". These documents will be available for consultation before and at the time of confirming the purchase.

Le Tapis Rouge Paris may update and modify the present General Terms and Conditions of Sale. Customers will be informed by e-mail of such changes. The conditions applicable to the sale of items are those in force at the time of the conclusion of the sales contract.

For more information on the processing by Le Tapis Rouge Paris of personal data collected on the Site, the Customer is invited to read the Privacy Policy.

Article 2 - Order Information

Orders can be placed on the Site.

The languages available for orders placed through the Site are French, English, Spanish, Italian, Russian, Portuguese, German, Dutch, Chinese, Arabic.

The language of the sales contract depends on the country in which the Site is hosted and in which you purchase the Item(s).

2.1 Orders placed on the Site

2.1.1 Selection of items by the Customer

On the Site, the Customer selects, enters and validates the identification and the quantity of the Articles he wishes to order, within the limits of quantities indicated in article 4 below; the aforementioned Articles are added to his "Basket".

The Customer can, on line, freely modify his " Basket " made up of the selected Articles, remove an initially selected Article, modify the ordered quantities or add an Article by clicking on the corresponding elements in his " Basket ".

2.1.2 Identification

Once the Customer has completed his selection and wishes to validate the contents of his Shopping Cart, he may either:
- log in to his Customer account (hereinafter the "Account"), or
- continue as a "guest".
The Customer can also identify himself before selecting items.

 

If the Customer already has an Account, he/she must identify himself/herself with his/her e-mail address and password.
If the Customer does not have an Account yet, he/she can create one by confirming his/her name, residence address, e-mail address and telephone number when ordering.
The registration will be effective once confirmed, via a confirmation email, by Le Tapis Rouge Paris.

The Customer will not be able to request a change of address once the order has been placed, the Customer will have to place another order with the new address.

Further information on the processing of the Customer's personal data is available in the Privacy Policy.

The Customer's login and password are strictly personal. Consequently, each Customer commits to keep them in a safe place and never to communicate them to third parties.
In case of loss, theft, or any fraudulent use of their account, customers agree to inform Le Tapis Rouge Paris immediately.
Le Tapis Rouge Paris cannot be held responsible for any direct or indirect damage caused by fraudulent access to the Account or the Site or the impossibility to access it.

2.1.3 Order validation

The Customer must validate the delivery method and complete the information necessary for the proper shipment of the order:
- e-mail,
- name and surname,
- address,
- postal code,
- city,
- telephone number,
- delivery method,
- country of shipment,
- billing address,
- and delivery address or store where the Customer wishes to pick up the order if the selected country of delivery has stores offering this service.
- choice of a payment method and payment information.

The Customer can use his delivery address as his billing address or enter another one.

Once all this information is regularly entered and validated, the price of the Articles (as defined in article 5 hereafter) as well as the possible carriage costs and the estimated date of delivery are automatically displayed.

The Customer must check the accuracy of his selection before confirming his order.
Le Tapis Rouge Paris provides the Customer with technical means of verification in the form of a standard completeness and plausibility check summary (allowing to verify if all mandatory fields have been filled in and if the characters entered are appropriate for the mandatory field in question) to help the Customer recognize any errors he may have made in his entries.
The customer's order data is then summarized again for final checking.

By clicking on the "Pay and Place Order" button, the Customer places a binding order for the Item(s) in his or her Shopping Cart.
The Customer can only place an order if he/she acknowledges and accepts the present General Terms and Conditions of Sale and the Privacy Policy by clicking on the "Pay and Place Order" button.

2.1.4 Confirmation of the order by Le Tapis Rouge Paris

Once the steps provided for in Article 2.2.3 above have been completed, an acknowledgement of receipt of the order is sent to the Customer by e-mail. In accordance with the provisions of Article 1126 of the Civil Code,

The Customer accepts the use of electronic mail for the confirmation by Le Tapis Rouge Paris of the content of his order. This acknowledgement of receipt of the order does not constitute an acceptance of the Customer's order, unless otherwise expressly stipulated.

The sales contract is deemed concluded when the item(s) that the Customer has ordered is/are shipped and the Customer has received a separate email from Le Tapis Rouge Paris informing him/her of the shipment of his/her order.

In the event of payment by credit card, the sales contract is concluded at the time the Customer's credit card is debited in accordance with the terms of Article 6 hereof, even if the Customer's credit card is debited prior to shipment of the order or prior to acceptance expressed by another means.

In the event of payment by PayPal, Apple Pay or Apple Pay express as provided for under the terms of Article 6.2 hereof, the sales contract shall be deemed to have been concluded at the time the Customer confirms the order on the PayPal, Apple Pay or Apple Pay express website.

The order acknowledgement includes the order number, the total amount of the order, information about the cost and delivery time, the essential characteristics, the quantity and the price of the Item(s) purchased. This acknowledgement includes a link to the General Terms and Conditions of Sale.

At the time of shipment of the item(s) ordered to the delivery address chosen by the Customer, Le Tapis Rouge Paris will send an email to the Customer informing him/her of the said shipment as well as the collection of the price, as provided for in Article 5 below. The sales contract is then definitively formed.

2.2 Proof of order

In general, it is expressly agreed between Le Tapis Rouge Paris and the Customer that e-mails will be deemed authentic between the parties, as will the automatic recording systems used by the Customer Relations Department, particularly as regards the nature and date of the order.
In addition, in application of article L. 213-1 of the French Consumer Code, Le Tapis Rouge Paris retains all information relating to any order amounting to or exceeding one hundred and twenty (120) euros for a period of ten (10) years. 213-1 of the French Consumer Code, Le Tapis Rouge Paris retains information relating to all orders of one hundred and twenty (120) euros or more for a period of ten (10) years, and makes this information available to the customer upon request to: contact@letapisrougeparis.com or to Le Tapis Rouge Paris - Service Relation Clientèle - 58 Rue du Faubourg Poissonnière - 75010 Paris.
It is recommended, however, that for orders placed on the Site, the customer also retains a copy (in electronic format and/or on paper) of the information relating to his or her order.

Article 3 - Availability of items

Le Tapis Rouge Paris reserves the right to change at any time and without notice the Article(s) offered on the Site, without affecting orders already placed.

Before placing an order, the Customer is informed on the information page of the Site describing each of the Articles:

- of the availability of the Article; or
- in case of temporary unavailability of the Article, of the possibility of ordering it for a later delivery within the time limits specified on this occasion.

If, despite the vigilance of Le Tapis Rouge Paris, the ordered items are no longer available, Le Tapis Rouge Paris will inform the Customer by any means (phone call or e-mail) as soon as possible.

Exceptionally, in case of stock shortage of the ordered article, Le Tapis Rouge Paris will be obliged to cancel an order placed, in this case, no amount will be paid by the Customer.

Article 4 - Refusal of order

Purchases made on the Site are reserved to Customers for their own use (or for gifts) and not for resale.

Le Tapis Rouge Paris will have the right to refuse any fraudulent or abnormal order.

Le Tapis Rouge Paris will also have the right to refuse any order: (i) made by a Customer with whom there is a dispute relating to payment or delivery of a previous order; or (ii) not in accordance with these Terms and Conditions.

If Le Tapis Rouge Paris finds that the order does not comply with these Terms and Conditions of Sale, it will inform the Customer either directly on the Site, or by telephone, or by e-mail.
If the customer fails to proceed with the correction of erroneous elements or contrary to these Terms and Conditions of Sale contained in the order within fourteen (14) calendar days following the notification above, Le Tapis Rouge Paris reserves the right to cancel the order and the corresponding payment.

Article 5 - Price of the Articles - Invoicing

The prices communicated by the Customer Relations Department or displayed on the Site are indicated in Euros (€) and include all taxes (TTC), excluding delivery costs, the latter being displayed separately before the order is placed.

The prices invoiced are those in effect on the date of the order, subject to the availability of the item(s) ordered at that time.

Without prejudice to the orders already placed by the Customer, Le Tapis Rouge Paris reserves the right to modify at any time and without notice the prices of the Articles.

It is specified that the tax-free service is not available for purchases of Le Tapis Rouge Paris items made on the Site.

The Customer will receive, at the latest at the time of the delivery, for each of the Articles, the written confirmation of the paid price detailing the price by Article and the expenses of delivery put at his charge.

Article 6 - Terms of payment

6.1 Payment by Credit or Debit Card

The payment of the Customer's purchases can be made by credit card or debit card. Cards from the "CB" network, Visa©, MasterCard©, American Express©, ApplePay© are accepted. Cards issued by banks domiciled outside France must be international bank cards.

The transaction is then carried out by the Customer according to the banking security standards. The authentication is specific to each bank. By communicating his credit card number and/or bank details to Le Tapis Rouge Paris on the Site, the Customer accepts in advance and unconditionally that Le Tapis Rouge Paris proceeds with the secure transaction and authorizes in advance his bank to debit his account at the sight of the records or statements transmitted by Le Tapis Rouge Paris, even in the absence of invoices signed by the holder of the credit card used.

The sales contract is concluded at the time the Customer's credit card is debited if this debit takes place prior to the shipment of the Item(s). However, this does not apply to advance payments and other payments made by the Customer when the debit is made in the amount of the advance payment on the agreed date.

6.2 Payment by PayPal (Internet orders only)

Le Tapis Rouge Paris accepts payments made via PayPal (for orders placed on the Site only).

At the time of the validation of the order, the Customer chooses the "PayPal" payment option and will be automatically redirected to the "PayPal" platform.

The Customer will then have to connect to his "PayPal" account via his contact information. If the Customer does not have a "PayPal" account, he or she may create one at that time. After validation of his order with "PayPal", the Customer will be redirected to the confirmation page of the Site.

The order will be shipped only after verification of the payment method, receipt of the authorization to debit the Customer's credit card or confirmation from PayPal and verification of the compliance of the order with these Terms and Conditions of Sale.

Article 7- Delivery of the Articles

The Articles can be delivered in the whole world. If the Customer wishes to order an Item and have it delivered to a country other than metropolitan France, it is possible that he/she will have to pay additional delivery charges.

For security reasons, Le Tapis Rouge Paris will not process any order for which the billing or delivery address is a post office box.
Also for security reasons, deliveries in a hotel or a student residence are possible provided you choose the express delivery with proof of hand delivery.

The Customer also has the option of having the Items delivered to another natural person whose delivery address is located in metropolitan France when the Item(s) ordered is/are a gift(s).

The delivery of the Articles will intervene, after the payment of the amount of the order will have been recorded, at the delivery address indicated by the Customer during the ordering process. To this end, the latter undertakes to have communicated an exact delivery address to Le Tapis Rouge Paris.

The delivery of the ordered Articles will intervene (subject to the integral payment of the price):

- either, on the date or within the period indicated to the Customer by Le Tapis Rouge Paris before the order is confirmed, or, if no period has been provided, without undue delay, and at the latest within thirty (30) days following the date of the order;

- or, in the event of temporary unavailability of the said Article, within the time limits of which the Customer will be notified in advance and which he will have accepted: (i) at the time of his order; (ii) at the time of adding an Article to his "Basket" on the Site as well as before the acceptance of his order.

Le Tapis Rouge Paris will deliver the ordered items by standard or express mail with proof of hand delivery according to the choice made by the Customer.

Delivery charges by standard mail in France are paid by Le Tapis Rouge Paris. Delivery costs by express mail with proof of hand delivery are charged to the Customer.

In case of delay in the delivery of items due to an event beyond the control of Le Tapis Rouge Paris, the Customer will be contacted as soon as possible and steps will be taken to minimize the effects of the delay. Le Tapis Rouge Paris will do everything possible to minimize the delay. However, if there is a risk of significant delay, the Customer may contact Le Tapis Rouge Paris to terminate the contract and obtain a refund of any item that has been paid for but not received.

In case of failed delivery by one of our partner carriers (after 3 unsuccessful attempts), and return of the package to the warehouse of Le Tapis Rouge Paris for the reason NPAI (Does not live at the address indicated), Le Tapis Rouge Paris will try to contact the Customer two (2) times in four (4) weeks, after receipt of the package at the warehouse. Without any answer/confirmation from the Customer within these four (4) weeks, Le Tapis Rouge Paris will proceed to the refund of the order, and the Customer will receive the confirmation by email, at the address given during the order.

Article 8 - Protection of privacy

You have the option of registering on the anti-demarketing list available at http://www.bloctel.gouv.fr.

Article 9 - Ownership of items

Le Tapis Rouge Paris remains the owner of the Items until (a) the Customer or (b) the person designated by the Customer takes physical possession of the Item(s).

The Customer is not entitled to resell the delivered items subject to retention of title, except with the prior written consent of Le Tapis Rouge Paris.

Article 10 - Intellectual Property Rights

The Customer shall not reproduce, represent or adapt, directly or indirectly, the Site, in whole or in part, in any form whatsoever. Any intellectual property right pertaining to any product or element of Le Tapis Rouge Paris (including Le Tapis Rouge Paris items), such as trademarks, illustrations, photos, images, models and logos, whether registered or not, is and will remain the exclusive property of Le Tapis Rouge Paris.

Any total or partial reproduction, downloading, modification or use of the trademarks, illustrations, images, photos, logos and models of Le Tapis Rouge Paris, for any reason and on any medium whatsoever, without the express prior written consent of Le Tapis Rouge Paris, is strictly forbidden.
Similarly, any use not in compliance with the Site's user license and, in particular, the use of any of its components (items presented, descriptions, prices, data, software, graphics, images, texts, photographs, tools, etc.) for sale or any other direct or indirect commercial use, is strictly forbidden without the prior written consent of Le Tapis Rouge Paris

Article 11 - Legal right of withdrawal

11.1 Right of withdrawal

In accordance with the provisions of Articles L. 221-18 et seq. of the Consumer Code, as a consumer, you have the right to exercise your right of withdrawal within a period of fourteen (14) days and without having to justify the reason(s).

 

The withdrawal period will expire after fourteen (14) days from the day on which you, or a third party indicated by you other than the carrier, have acquired physical possession of the Item. In the case of an order for several Items delivered separately, the period shall run from the date of receipt of the last Item.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from your purchase by an unequivocal statement under the conditions specified in article 13.1. If you wish, you can use the retraction form available from contact@letapisrougeparis.com.
In order to respect the deadline for retraction, you simply need to send your declaration of retraction before the deadline expires.
In accordance with article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to purchases of goods made at your request or clearly personalized, to goods which you have unsealed and which cannot be returned for reasons of hygiene or health protection, or to Items which have been inseparably linked with other goods after delivery of the Items.
Furthermore, in the case of a gift, the right of withdrawal remains for the exclusive benefit of the Customer and cannot under any circumstances be exercised by the recipient of the gift.

11.2 Effects of withdrawal

If you withdraw, we will refund all payments received by us from you, including delivery charges (except for additional charges resulting from your choice of delivery other than the standard delivery offered), within a reasonable period of time and in any event no later than fourteen (14) days from the date we are informed of your decision to withdraw from the contract. However, we reserve the right to defer the refund until we have received back the Items subject to the right of withdrawal or until you have provided us with proof of shipment of the Items, whichever is earlier.

We will make this refund using the same payment method you used for the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a result of this refund.

 

You shall only be liable for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and function of the goods.

You will make the returns of the Article(s), at your expense. You must return the Article(s) to the following address 2 Rue Eugène Pottier (Batiment C, 95670 Marly-la-ville) no later than fourteen (14) days from the date on which you informed us of your intention to withdraw from the sales contract.

 

 

Article 12 - Voluntary return policy

In addition to your legal right of withdrawal mentioned in Article 12 hereof, Le Tapis Rouge Paris guarantees the Customer a period of thirty (30) days to cancel the purchase and return the Items purchased on the Site.

The Customer does not have such a right for:
- personalized or custom-made items and items made at the request of the Customer;
- items that have been permanently linked with other items after the delivery of the items;

In all cases, the return of the delivered Article(s) must be made by the Customer:

- within thirty (30) days of delivery of the Items;
- accompanied by the attached return form duly completed or by an unequivocal statement indicating Customer's decision to return the Items; and
- in its/their complete original packaging.

Items not returned or returned incomplete, defaced, unlabeled, damaged, soiled or in any other condition that would reasonably suggest use or wear will not be refunded or exchanged and will be returned to Customer.

Returned items must be in their original, unused condition, with all Le Tapis Rouge Paris item tags attached and any associated accessories or instruction booklets included.

If an item has been returned more than thirty (30) days after the date of receipt or collection by the Customer, Le Tapis Rouge Paris reserves the right not to make any refund and the item will be returned to the Customer.

In addition, in the case of a gift, the right of voluntary return remains in the exclusive benefit of the Customer and cannot in any case be exercised by the recipient of the gift.

The Customer's statutory right of withdrawal under Article 12 shall in no way be affected by this voluntary right of return. Until the expiration of the fourteen (14) day cancellation period provided for in Article 12, the provisions listed therein shall apply exclusively.

 

12.1 Voluntary return policy via the Site

The Customer can return the purchased Articles, within thirty (30) days, for that it will be able alternatively

  1. notify his wish to return to Le Tapis Rouge Paris via his account opened on the Site, in which case Le Tapis Rouge Paris will acknowledge receipt by e-mail of the Customer's cancellation thus notified; and
  2. return the item(s) to the following address 2 Rue Eugène Pottier (Batiment C, 95670 Marly-la-ville).

The refund of the invoiced price of the Article(s) returned via the Site will be made on the means of payment used to pay for the order, without excessive delay and in any case no later than fourteen (14) days after receipt by Le Tapis Rouge Paris of said Articles.

Additional fees paid by the Customer related to the choice of a specific delivery method will not be refunded.

Article 13 - Exchange

In addition to the Customer's right to withdraw and return Items in accordance with Articles 12 and 13 hereof, the Customer may also change his mind and exchange an Item within thirty (30) days, under the conditions provided for in Article 13.
In the event that an Item is defective, please refer to Article 15 hereof.

In case of request for exchange, the Customer can exchange an Article via the Site Le Tapis Rouge Paris by filling out our exchange form within thirty (30) days from the date of receipt of said Article.

Without prejudice to the rights of the Customer provided for in Article 13, Le Tapis Rouge Paris reserves the right, as part of its exchange policy, to refuse an exchange beyond two (2) successive orders.

The Customer will not be able to carry out two exchanges for the same order, in the event of wish of exchange of Articles having already been the subject of an exchange, the Customer will be able to turn over the Article(s) by contacting the Service Relation Customers by telephone and to be made refunding.

The exchange of Items is subject to the availability of the said Items on the Site or in stock. In the event that the Article(s) is/are unavailable, the Customer will be reimbursed under the conditions provided for in Article 12.1

13.1 Exchange of Items via the Site

If the Customer changes his mind and wishes to exchange one or more Items via the Site, the Customer must specify in the appropriate section of the Site which Item(s) he wishes to receive in exchange for his order. The Customer may return an Item(s) under the conditions provided for in Article 13 above (time limit, exchange conditions).

The number of replacement items must be the same as the number of items returned.

The shipping costs of the first delivery will be refunded but the shipping costs of the second delivery will be charged according to the delivery method chosen. The new sale will be subject to the General Conditions of Sale in effect at the time of the exchange.

Article 14 - Customer's rights in case of defect of the Articles

In case of defect of the Article(s), the legal provisions, in particular the legal guarantees, apply.

Le Tapis Rouge Paris is held responsible for the defects of conformity of the Articles (articles L. 217-4 to L. 217-16 of the Code of Consumption) and for hidden defects under the conditions provided for in articles 1641 to 1649 and 2232 of the Civil Code.

When acting under the legal warranty of conformity, the Customer :

  • has a period of two years from the delivery of the goods to act;
    - may replace the goods, provided that the Customer's choice does not entail a cost that is manifestly disproportionate to the other method, given the nature or value of the goods or the importance of the defect;
    - is exempt from proving the existence of the lack of conformity of the goods during the twenty-four (24) months following the delivery of the goods.

In addition, the legal guarantee of conformity applies independently of the commercial guarantee that may have been granted. Le Tapis Rouge Paris does not systematically grant a commercial guarantee in addition to the legal guarantee.

The Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, the Customer can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

Article 15 - After-sales service

All technically repairable Items are eligible for after-sales service.

Article 16 - Information about the Articles

The information relating to the whole of the Articles proposed with the remote sale is available on the Site or via the Customer Relations Service.

The photographs, graphics and descriptions of the items offered for sale are only indicative and do not commit Le Tapis Rouge Paris. Customers can obtain additional information by contacting the Customer Service or the stores Le Tapis Rouge Paris. While every effort is made to ensure that the color and design of the items whose photos are displayed on the Site are faithful to the original items, variations may occur, particularly due to technical limitations of color rendering on your computer equipment. Therefore, Le Tapis Rouge Paris cannot be held responsible for errors or inaccuracies not substantial of the photographs or graphic representations of the Articles on the Site.

Article 17 - Miscellaneous

The fact that Le Tapis Rouge Paris refrains from demanding at a given time the execution of any of the stipulations of these General Conditions of Sale cannot be interpreted as a waiver to invoke later said total or partial non-execution.

 

If any of the provisions of these General Terms and Conditions of Sale are declared invalid in whole or in part, the other provisions and the other rights and obligations arising from these General Terms and Conditions of Sale shall remain unaffected and applicable.

Article 18 - Dispute Resolution - Applicable Law

The present General Terms and Conditions of Sale are subject to French law, except for mandatory provisions to the contrary such as those arising from the EC Regulation n°593/2008 of June 17, 2008 on the law applicable to contractual obligations (Rome I). This choice of law does not affect the Customer's right to benefit from the regulations applicable to consumer protection in the Customer's country of residence.

In case of difficulty arising from the order or delivery of the items, the customer will have the possibility, before any legal action, to seek an amicable solution with Le Tapis Rouge Paris and to have recourse to the CMAP - Centre de Médiation et d'Arbitrage de Paris, the consumer mediator of which Le Tapis Rouge Paris is a part.

To submit a dispute to the mediator, the Customer can fill in the form on the CMAP website: www.cmap.fr tab "you are: a consumer", send his request by simple or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or send an email to consommation@cmap.fr. Whatever the means used to seize the CMAP, the Customer's request must contain the following elements to be treated with rapidity: his postal address, e-mail and telephone number as well as the complete name and address of the company Le Tapis Rouge Paris, a brief statement of the facts, and the proof of the steps taken by the Customer with Le Tapis Rouge Paris before seizing the CMAP.

The Customer remains free to accept or refuse the recourse to mediation and, in case of recourse to mediation, each party is free to accept or refuse the solution proposed by the mediator.

In the absence of an amicable solution or recourse to mediation, all disputes to which the general conditions of sale could give rise will be submitted to the competent court in application of the rules laid down by the code of civil procedure and the code of consumption. The Customer may bring an action before the courts of (i) the place of residence of Le Tapis Rouge Paris; or (ii) the place of residence of the Customer; or (iii) the place of delivery of the Articles.

These General Terms and Conditions of Sale are those of Le Tapis Rouge Paris, a limited liability company with a share capital of 5,000 euros, having its registered office at 58 rue du Faubourg Poissonnière, 75010 Paris, registered in the Paris Trade and Companies Register under number 911 344 497 - E-mail address: contact@letapisrougeparis.com; VAT FR 39 911344497 (hereinafter " Le Tapis Rouge Paris ").

Le Tapis Rouge Paris creates, designs, manufactures and markets pet supplies worldwide.

Article 1 - Scope and acceptance of the General Terms and Conditions of Sale

The present General Conditions of Sale are applicable to all the sales of Articles concluded at distance:

Via the website of Le Tapis Rouge Paris identified by the domain name "http://www.letapisrougeparis.com/fr_fr" (hereinafter the " Site ").

The Articles are sold to end customers who are natural persons, acting for strictly personal purposes and not for any commercial activity, thus excluding any resellers or any intermediaries acting in the name and on behalf of resellers (hereinafter the " Customer (s)" or " you ").

Therefore, Customer represents and warrants that it is acting as a consumer and does not intend to resell the Items for commercial purposes.

The Customer also certifies that he/she has the legal capacity to commit himself/herself under the terms of the present General Sales Conditions.

At the time of each purchase of Article(s) on the Site, the Customer will have to indicate his acceptance of the General Conditions of Sale in force by clicking on the button "Pay and place an order". These documents will be available for consultation before and at the time of confirming the purchase.

Le Tapis Rouge Paris may update and modify the present General Terms and Conditions of Sale. Customers will be informed by e-mail of such changes. The conditions applicable to the sale of items are those in force at the time of the conclusion of the sales contract.

For more information on the processing by Le Tapis Rouge Paris of personal data collected on the Site, the Customer is invited to read the Privacy Policy.

Article 2 - Order Information

Orders can be placed on the Site.

The languages available for orders placed through the Site are French, English, Spanish, Italian, Russian, Portuguese, German, Dutch, Chinese, Arabic.

The language of the sales contract depends on the country in which the Site is hosted and in which you purchase the Item(s).

2.1 Orders placed on the Site

2.1.1 Selection of items by the Customer

On the Site, the Customer selects, enters and validates the identification and the quantity of the Articles he wishes to order, within the limits of quantities indicated in article 4 below; the aforementioned Articles are added to his "Basket".

The Customer can, on line, freely modify his " Basket " made up of the selected Articles, remove an initially selected Article, modify the ordered quantities or add an Article by clicking on the corresponding elements in his " Basket ".

2.1.2 Identification

Once the Customer has completed his selection and wishes to validate the contents of his Shopping Cart, he may either:
- log in to his Customer account (hereinafter the "Account"), or
- continue as a "guest".
The Customer can also identify himself before selecting items.

 

If the Customer already has an Account, he/she must identify himself/herself with his/her e-mail address and password.
If the Customer does not have an Account yet, he/she can create one by confirming his/her name, residence address, e-mail address and telephone number when ordering.
The registration will be effective once confirmed, via a confirmation email, by Le Tapis Rouge Paris.

The Customer will not be able to request a change of address once the order has been placed, the Customer will have to place another order with the new address.

The Customer's login and password are strictly personal. Consequently, each Customer commits to keep them in a safe place and never to communicate them to third parties.
In case of loss, theft, or any fraudulent use of their account, customers agree to inform Le Tapis Rouge Paris immediately.
Le Tapis Rouge Paris cannot be held responsible for any direct or indirect damage caused by fraudulent access to the Account or the Site or the impossibility to access it.

2.1.3 Order validation

The Customer must validate the delivery method and complete the information necessary for the proper shipment of the order:
- e-mail,
- name and surname,
- address,
- postal code,
- city,
- telephone number,
- delivery method,
- country of shipment,
- billing address,
- and delivery address or store where the Customer wishes to pick up the order if the selected country of delivery has stores offering this service.
- choice of a payment method and payment information.

The Customer can use his delivery address as his billing address or enter another one.

Once all this information is regularly entered and validated, the price of the Articles (as defined in article 5 hereafter) as well as the possible carriage costs and the estimated date of delivery are automatically displayed.

The Customer must check the accuracy of his selection before confirming his order.
Le Tapis Rouge Paris provides the Customer with technical means of verification in the form of a standard completeness and plausibility check summary (allowing to verify if all mandatory fields have been filled in and if the characters entered are appropriate for the mandatory field in question) to help the Customer recognize any errors he may have made in his entries.
The customer's order data is then summarized again for final checking.

By clicking on the "Pay and Place Order" button, the Customer places a binding order for the Item(s) in his or her Shopping Cart.
The Customer can only place an order if he/she acknowledges and accepts the present General Terms and Conditions of Sale and the Privacy Policy by clicking on the "Pay and Place Order" button.

2.1.4 Confirmation of the order by Le Tapis Rouge Paris

Once the steps provided for in Article 2.2.3 above have been completed, an acknowledgement of receipt of the order is sent to the Customer by e-mail. In accordance with the provisions of Article 1126 of the Civil Code,

The Customer accepts the use of electronic mail for the confirmation by Le Tapis Rouge Paris of the content of his order. This acknowledgement of receipt of the order does not constitute an acceptance of the Customer's order, unless otherwise expressly stipulated.

The sales contract is deemed concluded when the item(s) that the Customer has ordered is/are shipped and the Customer has received a separate email from Le Tapis Rouge Paris informing him/her of the shipment of his/her order.

In the event of payment by credit card, the sales contract is concluded at the time the Customer's credit card is debited in accordance with the terms of Article 6 hereof, even if the Customer's credit card is debited prior to shipment of the order or prior to acceptance expressed by another means.

In the event of payment by PayPal, Apple Pay or Apple Pay express as provided for under the terms of Article 6.2 hereof, the sales contract shall be deemed to have been concluded at the time the Customer confirms the order on the PayPal, Apple Pay or Apple Pay express website.

The order acknowledgement includes the order number, the total amount of the order, information about the cost and delivery time, the essential characteristics, the quantity and the price of the Item(s) purchased. This acknowledgement includes a link to the General Terms and Conditions of Sale.

At the time of shipment of the item(s) ordered to the delivery address chosen by the Customer, Le Tapis Rouge Paris will send an email to the Customer informing him/her of the said shipment as well as the collection of the price, as provided for in Article 5 below. The sales contract is then definitively formed.

2.2 Proof of order

In general, it is expressly agreed between Le Tapis Rouge Paris and the customer that emails will be considered as proof between the parties, as well as the automatic recording systems used by the Customer Relations Department, especially regarding the nature and date of the order.
In addition, pursuant to Article L. 213-1 of the Consumer Code, Le Tapis Rouge Paris keeps the elements related to any order of an amount equal to or greater than one hundred and twenty (120) euros for a period of ten (10) years and makes them available to the Customer upon request by the latter to: ltrpariscontact@gmail.com or to Le Tapis Rouge Paris - Service Relation Clientèle - 58 Rue du Faubourg Poissonnière - 75010 Paris.
It is however recommended, for the orders placed on the Site, that the Customer also keeps a copy (in electronic format and/or on paper) of the elements relating to his order.

Article 3 - Availability of items

Le Tapis Rouge Paris reserves the right to change at any time and without notice the Article(s) offered on the Site, without affecting orders already placed.

Before placing an order, the Customer is informed on the information page of the Site describing each of the Articles:

- of the availability of the Article; or
- in case of temporary unavailability of the Article, of the possibility of ordering it for a later delivery within the time limits specified on this occasion.

If, despite the vigilance of Le Tapis Rouge Paris, the ordered items are no longer available, Le Tapis Rouge Paris will inform the Customer by any means (phone call or e-mail) as soon as possible.

Exceptionally, in case of stock shortage of the ordered article, Le Tapis Rouge Paris will be obliged to cancel an order placed, in this case, no amount will be paid by the Customer.

Article 4 - Refusal of order

Purchases made on the Site are reserved to Customers for their own use (or for gifts) and not for resale.

Le Tapis Rouge Paris will have the right to refuse any fraudulent or abnormal order.

Le Tapis Rouge Paris will also have the right to refuse any order: (i) made by a Customer with whom there is a dispute relating to payment or delivery of a previous order; or (ii) not in accordance with these Terms and Conditions.

If Le Tapis Rouge Paris finds that the order does not comply with these Terms and Conditions of Sale, it will inform the Customer either directly on the Site, or by telephone, or by e-mail.
If the customer fails to proceed with the correction of erroneous elements or contrary to these Terms and Conditions of Sale contained in the order within fourteen (14) calendar days following the notification above, Le Tapis Rouge Paris reserves the right to cancel the order and the corresponding payment.

Article 5 - Price of the Articles - Invoicing

The prices communicated by the Customer Relations Department or displayed on the Site are indicated in Euros (€) and include all taxes (TTC), excluding delivery costs, the latter being displayed separately before the order is placed.

The prices invoiced are those in effect on the date of the order, subject to the availability of the item(s) ordered at that time.

Without prejudice to the orders already placed by the Customer, Le Tapis Rouge Paris reserves the right to modify at any time and without notice the prices of the Articles.

It is specified that the tax-free service is not available for purchases of Le Tapis Rouge Paris items made on the Site.

The Customer will receive, at the latest at the time of the delivery, for each of the Articles, the written confirmation of the paid price detailing the price by Article and the expenses of delivery put at his charge.

Article 6 - Terms of payment

6.1 Payment by Credit or Debit Card

The payment of the Customer's purchases can be made by credit card or debit card. Cards from the "CB" network, Visa©, MasterCard©, American Express©, ApplePay© are accepted. Cards issued by banks domiciled outside France must be international bank cards.

The transaction is then carried out by the Customer according to the banking security standards. The authentication is specific to each bank. By communicating his credit card number and/or bank details to Le Tapis Rouge Paris on the Site, the Customer accepts in advance and unconditionally that Le Tapis Rouge Paris proceeds with the secure transaction and authorizes in advance his bank to debit his account at the sight of the records or statements transmitted by Le Tapis Rouge Paris, even in the absence of invoices signed by the holder of the credit card used.

The sales contract is concluded at the time the Customer's credit card is debited if this debit takes place prior to the shipment of the Item(s). However, this does not apply to advance payments and other payments made by the Customer when the debit is made in the amount of the advance payment on the agreed date.

6.2 Payment by PayPal (Internet orders only)

Le Tapis Rouge Paris accepts payments made via PayPal (for orders placed on the Site only).

At the time of the validation of the order, the Customer chooses the "PayPal" payment option and will be automatically redirected to the "PayPal" platform.

The Customer will then have to connect to his "PayPal" account via his contact information. If the Customer does not have a "PayPal" account, he or she may create one at that time. After validation of his order with "PayPal", the Customer will be redirected to the confirmation page of the Site.

The order will be shipped only after verification of the payment method, receipt of the authorization to debit the Customer's credit card or confirmation from PayPal and verification of the compliance of the order with these Terms and Conditions of Sale.

Article 7- Delivery of the Articles

The Articles can be delivered in the whole world. If the Customer wishes to order an Item and have it delivered to a country other than metropolitan France, it is possible that he/she will have to pay additional delivery charges.

For security reasons, Le Tapis Rouge Paris will not process any order for which the billing or delivery address is a post office box.
Also for security reasons, deliveries in a hotel or a student residence are possible provided you choose the express delivery with proof of hand delivery.

The Customer also has the option of having the Items delivered to another natural person whose delivery address is located in metropolitan France when the Item(s) ordered is/are a gift(s).

The delivery of the Articles will intervene, after the payment of the amount of the order will have been recorded, at the delivery address indicated by the Customer during the ordering process. To this end, the latter undertakes to have communicated an exact delivery address to Le Tapis Rouge Paris.

The delivery of the ordered Articles will intervene (subject to the integral payment of the price):

- either, on the date or within the period indicated to the Customer by Le Tapis Rouge Paris before the order is confirmed, or, if no period has been provided, without undue delay, and at the latest within thirty (30) days following the date of the order;

- or, in the event of temporary unavailability of the said Article, within the time limits of which the Customer will be notified in advance and which he will have accepted: (i) at the time of his order; (ii) at the time of adding an Article to his "Basket" on the Site as well as before the acceptance of his order.

Le Tapis Rouge Paris will deliver the ordered items by standard or express mail with proof of hand delivery according to the choice made by the Customer.

Delivery charges by standard mail in France are paid by Le Tapis Rouge Paris. Delivery costs by express mail with proof of hand delivery are charged to the Customer.

In case of delay in the delivery of items due to an event beyond the control of Le Tapis Rouge Paris, the Customer will be contacted as soon as possible and steps will be taken to minimize the effects of the delay. Le Tapis Rouge Paris will do everything possible to minimize the delay. However, if there is a risk of significant delay, the Customer may contact Le Tapis Rouge Paris to terminate the contract and obtain a refund of any item that has been paid for but not received.

In case of failed delivery by one of our partner carriers (after 3 unsuccessful attempts), and return of the package to the warehouse of Le Tapis Rouge Paris for the reason NPAI (Does not live at the address indicated), Le Tapis Rouge Paris will try to contact the Customer two (2) times in four (4) weeks, after receipt of the package at the warehouse. Without any answer/confirmation from the Customer within these four (4) weeks, Le Tapis Rouge Paris will proceed to the refund of the order, and the Customer will receive the confirmation by email, at the address given during the order.

Article 8 - Protection of privacy

Article 9 - Ownership of items

Le Tapis Rouge Paris remains the owner of the Items until (a) the Customer or (b) the person designated by the Customer takes physical possession of the Item(s).

The Customer is not entitled to resell the delivered items subject to retention of title, except with the prior written consent of Le Tapis Rouge Paris.

Article 10 - Intellectual Property Rights

The Customer shall not reproduce, represent or adapt, directly or indirectly, the Site, in whole or in part, in any form whatsoever. Any intellectual property right pertaining to any product or element of Le Tapis Rouge Paris (including Le Tapis Rouge Paris items), such as trademarks, illustrations, photos, images, models and logos, whether registered or not, is and will remain the exclusive property of Le Tapis Rouge Paris.

Any total or partial reproduction, downloading, modification or use of the trademarks, illustrations, images, photos, logos and models of Le Tapis Rouge Paris, for any reason and on any medium whatsoever, without the express prior written consent of Le Tapis Rouge Paris, is strictly forbidden.
Similarly, any use not in compliance with the Site's user license and, in particular, the use of any of its components (items presented, descriptions, prices, data, software, graphics, images, texts, photographs, tools, etc.) for sale or any other direct or indirect commercial use, is strictly forbidden without the prior written consent of Le Tapis Rouge Paris

Article 11 - Legal right of withdrawal

11.1 Right of withdrawal

In accordance with the provisions of Articles L. 221-18 et seq. of the Consumer Code, as a consumer, you have the right to exercise your right of withdrawal within a period of fourteen (14) days and without having to justify the reason(s).

 

The withdrawal period will expire after fourteen (14) days from the day on which you, or a third party indicated by you other than the carrier, have acquired physical possession of the Item. In the case of an order for several Items delivered separately, the period shall run from the date of receipt of the last Item.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from your purchase by an unequivocal statement under the conditions specified in Article 13.1. If you wish, you can use the withdrawal form which you can request from us at contact@letapisrougeparis.com
In order to respect the deadline for withdrawal, you simply need to send your declaration of withdrawal before the deadline expires.
In accordance with article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to purchases of goods made at your request or clearly personalized, to goods which you have unsealed and which cannot be returned for reasons of hygiene or health protection, or to Articles which have been inseparably linked with other goods after delivery of the Articles.
Furthermore, in the case of a gift, the right of withdrawal remains for the exclusive benefit of the Customer and cannot under any circumstances be exercised by the recipient of the gift.

11.2 Effects of withdrawal

If you withdraw, we will refund all payments received by us from you, including delivery charges (except for additional charges resulting from your choice of delivery other than the standard delivery offered), within a reasonable period of time and in any event no later than fourteen (14) days from the date we are informed of your decision to withdraw from the contract. However, we reserve the right to defer the refund until we have received back the Items subject to the right of withdrawal or until you have provided us with proof of shipment of the Items, whichever is earlier.

We will make this refund using the same payment method you used for the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a result of this refund.

 

You shall only be liable for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and function of the goods.

You will make the returns of the Article(s), at your expense. You must return the Article(s) to the following address 2 Rue Eugène Pottier (Batiment C, 95670 Marly-la-ville) no later than fourteen (14) days from the date on which you informed us of your intention to withdraw from the sales contract.

 

 

Article 12 - Voluntary return policy

In addition to your legal right of withdrawal mentioned in Article 12 hereof, Le Tapis Rouge Paris guarantees the Customer a period of thirty (30) days to cancel the purchase and return the Items purchased on the Site.

The Customer does not have such a right for:
- personalized or custom-made items and items made at the request of the Customer;
- items that have been permanently linked with other items after the delivery of the items;

In all cases, the return of the delivered Article(s) must be made by the Customer:

- within thirty (30) days of delivery of the Items;
- accompanied by the attached return form duly completed or by an unequivocal statement indicating Customer's decision to return the Items; and
- in its/their complete original packaging.

Items not returned or returned incomplete, defaced, unlabeled, damaged, soiled or in any other condition that would reasonably suggest use or wear will not be refunded or exchanged and will be returned to Customer.

Returned items must be in their original, unused condition, with all Le Tapis Rouge Paris item tags attached and any associated accessories or instruction booklets included.

If an item has been returned more than thirty (30) days after the date of receipt or collection by the Customer, Le Tapis Rouge Paris reserves the right not to make any refund and the item will be returned to the Customer.

In addition, in the case of a gift, the right of voluntary return remains in the exclusive benefit of the Customer and cannot in any case be exercised by the recipient of the gift.

The Customer's statutory right of withdrawal under Article 12 shall in no way be affected by this voluntary right of return. Until the expiration of the fourteen (14) day cancellation period provided for in Article 12, the provisions listed therein shall apply exclusively.

 

12.1 Voluntary return policy via the Site

The Customer can return the purchased Articles, within thirty (30) days, for that it will be able alternatively

  1. notify his wish to return to Le Tapis Rouge Paris via his account opened on the Site, in which case Le Tapis Rouge Paris will acknowledge receipt by e-mail of the Customer's cancellation thus notified; and
  2. return the item(s) to the following address 2 Rue Eugène Pottier (Batiment C, 95670 Marly-la-ville).

The refund of the invoiced price of the Article(s) returned via the Site will be made on the means of payment used to pay for the order, without excessive delay and in any case no later than fourteen (14) days after receipt by Le Tapis Rouge Paris of said Articles.

Additional fees paid by the Customer related to the choice of a specific delivery method will not be refunded.

Article 13 - Exchange

In addition to the Customer's right to withdraw and return Items in accordance with Articles 12 and 13 hereof, the Customer may also change his mind and exchange an Item within thirty (30) days, under the conditions provided for in Article 13.
In the event that an Item is defective, please refer to Article 15 hereof.

In case of request for exchange, the Customer can exchange an Article via the Site Le Tapis Rouge Paris by filling out our exchange form within thirty (30) days from the date of receipt of said Article.

Without prejudice to the rights of the Customer provided for in Article 13, Le Tapis Rouge Paris reserves the right, as part of its exchange policy, to refuse an exchange beyond two (2) successive orders.

The Customer will not be able to carry out two exchanges for the same order, in the event of wish of exchange of Articles having already been the subject of an exchange, the Customer will be able to turn over the Article(s) by contacting the Service Relation Customers by telephone and to be made refunding.

The exchange of Items is subject to the availability of the said Items on the Site or in stock. In the event that the Article(s) is/are unavailable, the Customer will be reimbursed under the conditions provided for in Article 12.1

13.1 Exchange of Items via the Site

If the Customer changes his mind and wishes to exchange one or more Items via the Site, the Customer must specify in the appropriate section of the Site which Item(s) he wishes to receive in exchange for his order. The Customer may return an Item(s) under the conditions provided for in Article 13 above (time limit, exchange conditions).

The number of replacement items must be the same as the number of items returned.

The shipping costs of the first delivery will be refunded but the shipping costs of the second delivery will be charged according to the delivery method chosen. The new sale will be subject to the General Conditions of Sale in effect at the time of the exchange.

Article 14 - Customer's rights in case of defect of the Articles

In case of defect of the Article(s), the legal provisions, in particular the legal guarantees, apply.

Le Tapis Rouge Paris is held responsible for the defects of conformity of the Articles (articles L. 217-4 to L. 217-16 of the Code of Consumption) and for hidden defects under the conditions provided for in articles 1641 to 1649 and 2232 of the Civil Code.

When acting under the legal warranty of conformity, the Customer :

  • has a period of two years from the delivery of the goods to act;
    - may replace the goods, provided that the Customer's choice does not entail a cost that is manifestly disproportionate to the other method, given the nature or value of the goods or the importance of the defect;
    - is exempt from proving the existence of the lack of conformity of the goods during the twenty-four (24) months following the delivery of the goods.

In addition, the legal guarantee of conformity applies independently of the commercial guarantee that may have been granted. Le Tapis Rouge Paris does not systematically grant a commercial guarantee in addition to the legal guarantee.

The Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, the Customer can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

Article 15 - After-sales service

All technically repairable Items are eligible for after-sales service.

Article 16 - Information about the Articles

The information relating to the whole of the Articles proposed with the remote sale is available on the Site or via the Customer Relations Service.

The photographs, graphics and descriptions of the items offered for sale are only indicative and do not commit Le Tapis Rouge Paris. Customers can obtain additional information by contacting the Customer Service or the stores Le Tapis Rouge Paris. While every effort is made to ensure that the color and design of the items whose photos are displayed on the Site are faithful to the original items, variations may occur, particularly due to technical limitations of color rendering on your computer equipment. Therefore, Le Tapis Rouge Paris cannot be held responsible for errors or inaccuracies not substantial of the photographs or graphic representations of the Articles on the Site.

Article 17 - Miscellaneous

The fact that Le Tapis Rouge Paris refrains from demanding at a given time the execution of any of the stipulations of these General Conditions of Sale cannot be interpreted as a waiver to invoke later said total or partial non-execution.

 

If any of the provisions of these General Terms and Conditions of Sale are declared invalid in whole or in part, the other provisions and the other rights and obligations arising from these General Terms and Conditions of Sale shall remain unaffected and applicable.

Article 18 - Dispute Resolution - Applicable Law

The present General Terms and Conditions of Sale are subject to French law, except for mandatory provisions to the contrary such as those arising from the EC Regulation n°593/2008 of June 17, 2008 on the law applicable to contractual obligations (Rome I). This choice of law does not affect the Customer's right to benefit from the regulations applicable to consumer protection in the Customer's country of residence.

In case of difficulty arising from the order or delivery of the items, the customer will have the possibility, before any legal action, to seek an amicable solution with Le Tapis Rouge Paris and to have recourse to the CMAP - Centre de Médiation et d'Arbitrage de Paris, the consumer mediator of which Le Tapis Rouge Paris is a part.

To submit a dispute to the mediator, the Customer can fill in the form on the CMAP website: www.cmap.fr tab "you are: a consumer", send his request by simple or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or send an email to consommation@cmap.fr. Whatever the means used to seize the CMAP, the Customer's request must contain the following elements to be treated with rapidity: his postal address, e-mail and telephone number as well as the complete name and address of the company Le Tapis Rouge Paris, a brief statement of the facts, and the proof of the steps taken by the Customer with Le Tapis Rouge Paris before seizing the CMAP.

The Customer remains free to accept or refuse the recourse to mediation and, in case of recourse to mediation, each party is free to accept or refuse the solution proposed by the mediator.

In the absence of an amicable solution or recourse to mediation, all disputes to which the general conditions of sale could give rise will be submitted to the competent court in application of the rules laid down by the code of civil procedure and the code of consumption. The Customer may bring an action before the courts of (i) the place of residence of Le Tapis Rouge Paris; or (ii) the place of residence of the Customer; or (iii) the place of delivery of the Articles.
